Introduction
Welcome to Drivers4Me, operated by Car Driver4Me Solution Private Limited ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Drivers4Me platform, including our website (www.drivers4me.com), mobile application, and all related services (collectively, the "Service").
Drivers4Me provides a technology-based service which enables the hiring of drivers by commuters and passengers for point-to-point pick-up and drop-off services within city limits, as well as outstation and subscription-based driver services across India.
By accessing or using our Service in any way, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Service. We reserve the right to modify these Terms at our sole discretion; continued use after any change implies acceptance of the revised Terms.

Definitions
The following terms have the meanings set out below whenever they appear in these Terms:
- "Drivers4Me" refers to Car Driver4Me Solution Private Limited, its affiliates, officers, employees, agents, and licensors.
- "User" means any individual who accesses or uses the Website or Application, whether as a passenger or driver.
- "Application" means the Drivers4Me mobile application available on iOS and Android platforms.
- "Driver" means a licensed individual who has registered on the platform to provide driving services to Users.
- "Service" means the technology platform and all related services provided by Drivers4Me.
- "Website" means www.drivers4me.com and all sub-domains operated by Drivers4Me.

Service Description
Drivers4Me provides a technology-based marketplace platform that enables Users to hire professional drivers for point-to-point pick-up and drop-off services. The platform acts solely as an intermediary connecting passengers with independent, licensed drivers.
Drivers4Me itself does not provide transportation services. Users authorise Drivers4Me to operate their vehicles during the designated service period, or, where the User is a passenger, to facilitate the assignment of a suitable driver. Drivers who provide services through the platform are independent contractors and not employees of Drivers4Me.
- On-demand driver bookings for in-city point-to-point trips.
- Pre-scheduled outstation and long-distance journeys with professional drivers.
- Subscription plans providing regular driver availability for daily commutes or office use.
- Driver tracking and real-time status updates through the app.
- Digital receipts, trip history, and D4M Wallet management.

Use of Service, Application and Website
When you use the Application or Website, GPS-based location detection may send your information to nearby drivers to facilitate booking. Drivers4Me has sole discretion to accept or reject any service request. The Company reserves the right to refuse service to any User at any time without assigning a reason.
Drivers4Me shall not be liable for the conduct of any driver accessed through the platform. You acknowledge that all transportation services are provided by independent drivers and that Drivers4Me is not responsible for the quality, safety, or legality of those services.

User Eligibility & Agreement
To use the Service, you must meet the following eligibility requirements:
- You must be at least 18 years of age as required under Indian Law.
- You must be legally competent to execute binding contracts under the Indian Contract Act, 1872.
- You have the legal authority to enter into this agreement on behalf of yourself or the entity you represent.
- All information you provide to us is accurate, current, and complete.
The Company may refuse service to any person or entity at its sole and absolute discretion, including where eligibility requirements are not met or cannot be verified.

Registration
To access certain features of the Service, you must register for an account. During registration you will be required to provide your name, contact number, email address, and such other details as specified in our Privacy Policy. When registering, you agree to:
- Provide accurate, complete, and current information during registration and keep it up to date.
- Maintain the security and confidentiality of your account credentials and not share them with any third party.
- Immediately notify us at contact@drivers4me.com if you suspect unauthorised access to your account.
- Be solely responsible for all activity that occurs under your account.
- Use one account per person — creating multiple accounts to circumvent restrictions is prohibited.
Misuse or misrepresentation of identity or contact details will lead to automatic termination of your account. Accounts with unverifiable identity may be suspended indefinitely.

Representations & Warranties
By using the Service, you represent and warrant that:
- All information provided to Drivers4Me is accurate, current, and complete.
- Private cars used for non-commercial purposes bear licence plates with black lettering over a white-coloured background, as required by applicable law.
- Your vehicle (where applicable) is in good operating condition and meets all statutory requirements.
- You are solely responsible for any and all liability which results from or is alleged as a result of the condition of your vehicle, including but not limited to personal injury and property damage claims.
- You hold valid liability insurance coverage as required by applicable law.
- You authorise Drivers4Me to process any sensitive personal data you provide in accordance with our Privacy Policy.

Meter Start & Cancellation Policy
When you make a booking through Drivers4Me, the following conditions apply:
Waiting Time
Drivers4Me drivers will wait no more than 15 minutes from the requested trip start time. If the User has not boarded the vehicle within this period, the driver may leave and a cancellation fee may apply.
Cancellation Policy
- Cancellations made more than 30 minutes before the scheduled pick-up time: no charge.
- Cancellations made within 30 minutes of the scheduled pick-up time: a cancellation fee of Rs 100/- will apply.
- No-shows without cancellation will be treated as a late cancellation and charged accordingly.
- Drivers who cancel confirmed trips without valid reason may face account penalties.
Booking Confirmation
A booking is confirmed only when you receive a confirmation notification via the app or SMS. Prices shown at booking are estimates and may vary based on actual trip distance, waiting time, toll charges, or applicable surcharges.

Payment
All fares and fees displayed on the platform are in Indian Rupees (INR) inclusive of applicable taxes unless otherwise stated. Trip fares are calculated upon trip completion.
- Payment may be made by cash or online methods including UPI, debit/credit cards, net banking, and D4M Wallet credits.
- Online payment processing is handled by third-party payment processors (PayTm and Razorpay). Drivers4Me is not responsible for issues arising from third-party processing, except where the error is attributable to our platform.
- D4M Wallet top-ups are non-refundable unless required by applicable law or RBI regulations.
- Surge pricing may apply during high-demand periods — you will be clearly informed before confirming your booking.
- Any disputes about charges must be raised within 24 hours of the trip by contacting our support team.
- Refunds, where applicable, are processed within 5–7 business days to the original payment method.
Drivers4Me deducts a service fee from the fare collected on behalf of drivers. The breakdown of this fee is available in your trip receipt.

Limitation of Liability
The information, recommendations, and/or Services provided to you on or through the Website/Application are for general information purposes only and do not constitute advice. Drivers4Me makes no warranties regarding the completeness or accuracy of any content on the platform.
To the maximum extent permitted by applicable law, Drivers4Me and its officers, employees, agents, and licensors shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Loss of data, revenue, profits, or business opportunities resulting from use or inability to use the Service.
- Website unavailability, malware, or failures in data transmission beyond our reasonable control.
- The acts or omissions of drivers, who are independent contractors and not employees of Drivers4Me.
- Delays, cancellations, or service disruptions caused by circumstances beyond our reasonable control (Force Majeure).
- Any damage to your vehicle or property arising from a driver's conduct.
Drivers4Me's aggregate liability shall in no event exceed the equivalent of the amount paid for the Services giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

Intellectual Property Rights
Drivers4Me is the sole owner or lawful licensee of all rights in the Website, Application, and their content — including the name, logo, design, software, text, images, and data — all of which are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial purposes. You may not:
- Duplicate, distribute, or create derivative works of any platform content without express written permission.
- Use our name, logo, or branding in any way that suggests endorsement or affiliation without prior authorisation.
- Reverse engineer, decompile, or attempt to extract the source code of any part of our software.
- Scrape, data-mine, or systematically extract information from the platform.
- Deep-link, page-scrape, or use automated tools to access the Service without written consent.

Privacy & Data Protection
Your privacy matters to us. Our collection, use, and storage of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the collection and use of your data as described in our Privacy Policy. Key points include:
- We collect location data during active trips to facilitate matching and navigation.
- Trip history is retained to support your account, dispute resolution, and service improvements.
- We may share relevant data with drivers necessary to fulfil your booking.
- We do not sell your personal data to third parties.
- You may request access to, correction of, or deletion of your personal data by contacting us at contact@drivers4me.com.

User Accounts, Offers & Promotions
Drivers4Me collects and stores User data including name and contact information in accordance with our Privacy Policy. The following additional conditions apply to your account and any promotional offers:
- Misuse or misrepresentation of identity or contact details will lead to automatic termination of your account.
- Promotional discounts and offers are provided at our sole discretion and are revocable at any time without prior notice.
- Accounts with unverifiable identity may be suspended indefinitely pending verification.
- Promotional credits and discount codes cannot be exchanged for cash and are subject to individual offer terms.

Termination
Drivers4Me may deny access to or terminate your account at any time, with or without notice, in order to protect its interests. Grounds for immediate termination include but are not limited to:
- Violation of any provision of these Terms.
- Providing false or misleading information during registration or use.
- Requests from law enforcement or regulatory authorities.
- Unexpected technical issues or safety concerns.
- Discontinuation of the Service in whole or in part.
- Interference with the rights of other Users or the operation of the platform.
Terminated Users may not recreate an account or access the Service under any other account without prior written consent from Drivers4Me. Provisions of these Terms that by their nature should survive termination — including payment obligations, intellectual property rights, indemnity, and limitation of liability — shall continue to apply.
You may close your account at any time by contacting us at contact@drivers4me.com.

Terms & Conditions for Use of Services
The following specific conditions apply to all Users when using the Service:
- Users are responsible for paying the driver fare along with any parking fees, surcharges, toll charges, and applicable taxes.
- The use of the Services provided by Drivers4Me is at the sole risk of the User. Services are provided on an "AS IS" basis with no guarantee of uninterrupted access.
- If any User misses their train, flight, or bus, Drivers4Me will not be liable for any compensation.
- Drivers may refuse service if a User is intoxicated, behaving in a disorderly manner, misusing in-vehicle devices, or requesting the driver to violate traffic laws.
- Complaints about a trip must be reported within 24 hours of the service by contacting our support team.
- Drivers4Me is authorised to use location-based telecom data to facilitate matching and navigation during active trips.
- Drivers4Me may terminate a booking at any time without assigning a reason.
- All users are expected to treat each other with respect and dignity. Verbal or physical harassment, abuse, or discrimination of any kind is strictly prohibited.

Indemnity
You shall defend, indemnify and hold Drivers4Me, its affiliates, licensors, and each of their officers, directors, other users, employees, attorneys, and agents harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with:
- Your violation of or non-compliance with these Terms or any applicable law or regulation.
- Your violation of any rights of a third party, including any intellectual property right, privacy right, or right of publicity.
- Your misuse of the Service or any content posted, transmitted, or submitted through the Service.
- Any claim that your content caused damage to a third party.
This obligation to indemnify will survive these Terms and your use of the Service.

D4M Wallet
The D4M Wallet is a closed-system mobile payment instrument as defined by the Reserve Bank of India (RBI), operated through payment gateway arrangements with PayTm and Razorpay. The following key terms govern its use:
Key Features
- D4M Wallet is a Closed System Payment Instrument as defined by the RBI. Cash withdrawal or redemption is not permitted.
- Currency: Indian Rupees (INR) only.
- Maximum reload limit: Rs 10,000/- at any time.
- Validity: 3 years from activation.
- Non-use forfeiture: balances are forfeited after 6 months of inactivity. 30 days' prior notice will be sent to your registered contact details.
- Wallet-to-Wallet and Wallet-to-Bank transfers are not currently available.
Balances
- Lifetime Balance: funds added by the User via recharge — valid for 3 years.
- Promotional Balance: funds credited by Drivers4Me — expires 30 days after credit.
- RBI regulations do not permit refund of any balance in your D4M Wallet back to your bank account except in cases of erroneous loading, which will be credited to the source account.
Account Security
- You are responsible for maintaining the confidentiality of your account credentials and PIN.
- Drivers4Me shall not be liable for any loss resulting from someone else using your password or account.
- Unauthorised access must be reported immediately to contact@drivers4me.com. Account blocking requests are processed within 72 hours.
- The account is non-transferable and tied to your registered mobile number.
Prohibited Uses
- Online gambling or any services prohibited by law.
- Remittance services or transfers to third parties.
- Any activity that violates applicable RBI guidelines or Indian law.

Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. The courts of Kolkata, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the Services or these Terms.
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes informally. Please contact us at contact@drivers4me.com. If a dispute is not resolved within 14 calendar days of written notice, it may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.
Arbitration proceedings shall be conducted in English before a single arbitrator mutually appointed by both parties.
